TWO COMPANY DIRECTORS CLAIM TRIAL TO MISAPPROPRIATING OVER 15,000 LITRES OF DIESEL

KOTA BHARU, July 4 (Bernama) -- Two company directors pleaded not guilty at the Sessions Court here today to misappropriating over 15,000 litres of diesel two years ago.

The defendants Tan Kim Soon, 35, and Koh Sze Yuen, 34, both directors of Heng Seng & Company Sdn Bhd, made the plea after the charges were read out before Judge Zulkifli Abllah.

The duo, who are husband and wife, were accused of possessing 15,979 litres of diesel, a scheduled controlled item, in violation of the Regulation 3(1) of the Control of Supplies Regulations 1974.

The couple were believed to have committed the offence in front of the Road Transport Department office in Laboh, Kuala Krai at about 7 pm on Oct 7, 2022, according to Section 21 of the Control of Supplies Act 1961 which can be punished under Section 22 (1) of the same act.

If convicted, they can be fined up to RM1 million or imprisoned for not more than three years or both.

Meanwhile, Heng Seng & Company Sdn Bhd was also charged with the same offence under Section 21 of the Control of Supplies Act 1961 and can be punished under Section 22 (2) of the same act which carries a maximum fine of RM2 million.

Wan Mohd I'zzat Wan Abdullah from the Ministry of Domestic Trade and Cost of Living (KPDN) appeared for the prosecution while Dahlia Tan represented both accused.

Wan Mohd I'zzat urged the court to impose an adequate bail taking into account the diesel leakage that occurred and in public interest while Dahlia asked for a lower bail taking into consideration the company’s earnings and that there was no risk the two accused would escape and they were prepared to report to the nearest KPDN.

The court allowed Kim Soon to be released on RM40,000 bail with one surety and allowed Sze Yuen to be released on RM30,000 bail with one surety, while the company was allowed bail at RM40,000. Both accused must surrender their passports and report to the Petaling Jaya KPDN every month.

The court fixed Aug 8 for case remention and document submission.
